This is the agreement between Ilmar Music (“us”, “we”) and the purchaser (“you”), and governs the use of sheet music and audio files (“music”) on ilmarmusic.com ("this website").
- You are licensed to download any music available while you have a current membership. You agree to use the music for your own personal use only.
- You may make unlimited copies of the music in any format for your own use. You acknowledge that at all times we retain the copyright on all the music.
- You agree not to provide third parties with copies of the music either by reselling or stealing the music.
- Any use of the music beyond your own personal use, including such things as public performance or derivative artworks must be agreed in writing with us.
- Once your membership has expired you may keep indefinitely any copies of the music that you have downloaded when your membership was current. However, if you should lose those copies after your membership has expired you will have to purchase a new membership if you wish to replace them.
- If you have purchased a subscription then this will rebill at the specified interval. You will be notified before this happens.
- If you have purchased a subscription you may cancel the rebilling at any time, your existing membership will not be affected, only the future membership.
- You may cancel your membership and request a refund within 14 days of a payment being taken. When you request a refund you must destroy all copies of any music you have downloaded since making the payment that you are being refunded.
- We will collect some personal information from you in order to provide you with this website and associated services. We will do this in a variety of ways, such as recording communications, or recording data on how you use ilmarmusic.com. We may use it in a variety of ways including, research, advertising on this website, fraud prevention, copyright protection and to contact you. However, we will not sell your contact information to third parties.
- We accept no liability for any loss, damage or injury that may arise from using the music or this website.
- This agreement is governed by the laws and courts of Scotland, UK. and in the event of any dispute the parties agree to submit to the non-exclusive jurisdiction of the Scottish courts. We may at our sole and exclusive discretion, bring action in any competent jurisdiction worldwide. In the event of a dispute you agree that you will communicate with us and attempt to resolve it in good faith before taking legal action.
- Should any part of this agreement be found to be unlawful, you agree that this shall not affect the enforcement of any other part of the agreement.
- We may alter this agreement at any time, giving you at least 30 days' notice by email informing you of the changes and when they come into force. If you are materially disadvantaged by a change in the terms and conditions you will be entitled to cancel your membership and receive a refund proportional to the time remaining on your membership.
- This agreement constitutes the entire agreement between us and you with regard to the use of this website and materials contained therein and with the exception of any fraudulent or negligent misrepresentations supersedes all prior oral or written understandings, communications or agreements not specifically incorporated herein. The only exception to this is any explicit terms you may have agreed to before joining this website, or any other supplementary terms made clear by us prior to your agreeing to this agreement. Any such terms will form part of this agreement.
